Kenyan lawyer Nelson Havi is on the spot for allegedly posting defamatory posts against respected advocate Danstan Omari, claiming that he wins cases because of ‘bribing judges.’

The remarks have attracted backlash from members of the public and have since led to a legal battle that may seem to bring more legal repercussions to him.

Havi was the president of the Law Society of Kenya some years back but was impeached before he completed his term. He also tried to vie for the position of president of the East Africa Law Society, where he bitterly lost to advocate Mukira Ramadhan Abubakar, who was endorsed by lawyer Danstan Omari.

”Consequently, lawyer Danstan Omari is left with no doubt that the publication is motivated by jealousy, ill will, and a misguided perception and is made to ruin and ridicule his professional journey as a zealous, serious, and uncompromising advocate. Especially due to his instructions related to certain matters he has been handling and his endorsement to his competitor, Mr. Mukira Ramadhan Abubakar, who triumphed in the recent polls,” said Lawyer Shadrack Wambui in a demand letter.

Back in Nairobi, Kenya, lawyer Danstan Omari’s star in the legal field has continued to glow, but according to the demand letter seen by our team, Havi’s comment must have been triggered by the same progress.

While addressing the press today in Nairobi, lawyer Omari told Havi to desist from defaming him and attacking the judiciary. Omari added that Havi was well-funded to bring the Judiciary to its knees.

”We are aware that you are heavily funded to fight the judiciary; although we all advocate for the eradication of graft, we are well aware that your war against the judiciary is malicious and is well paid for,” Omari said.

Omari said that all complaints within the Judiciary must be addressed through the correct channel, but Havi and the team have chosen the wrong path.

”It’s so unfortunate that you have decided to be a blogger; you have been well-funded to fight the judiciary, and we know it. Kindly use the correct channel to like the Judiciary Service Commission to address your issues,” Omari said.

Omari also urged Nelson Havi to stop being a blogger and concentrate on his legal career when he wanted to prosper in the legal field before its too late.

”Omari has supported a lot of us young advocates; he has taught law at the Catholic University of East Africa and is widely respected. Omari has also served as a high school deputy head teacher and is widely respected. we must make sure he is protected,” said lawyer Danstan Omari.

On the claims that he has won all the cases before Kenya’s Justice Alfred Mabeya. Omari faulted lawyer Havi for using too many words with no evidence.

He said that he had only had two cases before Justice Mabeya, where he won one and lost the other.

Omari, through Shadrack Wambui, has now demanded that Havi retract his comment, apologize through a full page of a Kenyan newspaper, and be ready to compensate him for the damages he has caused him.

Havi has yet to respond to the demand and letter.

Below is a demand letter addressed to embattled Havi as the case takes shape.
